TERMS & CONDITIONS

1. ITEM PHOTOS,DESCRIPTIONS & CONDITION CODES. We use every effort to accurately describe, represent and depictthe items we sell. This typically includes obtaining and sharing photographs ofthe item, obtaining information from the product?s data plate or other writteninformation and developing and sharing written descriptions of the item.Additionally, if feasible, it includes sharing information that we may have beenable to obtain regarding the item's use and maintenance history. Finally, itincludes classifying each item pursuant to a condition code.

OUR CONDITION CODES AREAS FOLLOWS:

A. NSOP-NEW SURPLUSORIGNAL PACKAGING. These are items that,to the best of our knowledge and belief, have never been used and that arestill in the original packaging. This item could be several years old and maynot be the most recent model, but it has never been placed in service. Thepackaging may show signs of wear or be out of date. The packaging for theseitems may also have writings, decals, stickers or other markings on them. Thepackaging may have been opened for inspection purposes. If you purchase an itemthat's condition is designated as "NSOP" and it does not work, wewill provide a full refund or replacement pursuant to the terms of ourHassle-Free Return Policy.

B. NSREM-NEW SURPLUSREMOVED FROM ORIGINAL PACKAGING. These are items that, to the best of our knowledge and belief,have never been used but that have been removed from the original packaging.These items may have cosmetic blemishes such as, but not necessarily limitedto, scratches, stains, minor dents, dings or other blemishes, but have neverbeen put into service. These items could be several years old but have neverbeen used. Examples of such items might include unused valves that were storedon a shelf in a company stock room. If you purchase an item where we designatethe condition as "NSREM" and you find the item unsuitable, we willprovide a full refund or replacement pursuant to the terms of our Hassle-FreeReturn Policy.

C. RE-REBUILT ORREFURBISHED. These are used itemsthat have been rebuilt or refurbished by a third party prior to our acquisitionand that have not been used since being rebuilt or refurbished. To ourknowledge and belief these items are in full working order but we have nottested them and cannot guarantee that they work. If you purchase an item wherewe designate the condition as "RE" and you find the item unsuitable,we will provide a full refund or replacement pursuant to the terms of ourHassle-Free Return Policy.

D. USTOG-USED TAKEOUT-GUARANTEED.These are useditems that have been taken out of service. Items bearing this designation wereknown or assumed to be working immediately prior to being taken out of service.Items in this category may have been removed from an industrial facility aspart of a plant liquidation or line shutdown or prior to the renovation ordemolition of the facility where the item was located. If you purchase and itemwhere we designate the condition as "USTOG" and you find the item tobe unsuitable, we will provide a full refund or replacement pursuant to theterms of our Hassle-Free Return Policy.

E. UAI- USED AS IS.These are used items that have been takenout of service. Although the item could be working, we have not tested the itemand do not have enough information to know or assume that the item was workingimmediately prior to being taken out of service. Items in this category mayhave been removed from an industrial facility as part of a plant liquidation orline shutdown or prior to the renovation or demolition of the facility wherethe item was located or could be used items that were stored in a company stockroom.If you purchase an item where the condition is designated as "UAI"the item is not subject to our Hassle-Free Return Policy, it is not guaranteedand all sales are final.

F. FPO- FOR PARTS ONLY.These are items that are known to beincomplete, not working or where a cursory inspection may show evidence ofsignificant damage or deterioration. If you purchase and item where thecondition is designated as "FPO" the item is not subject to ourHassle-Free Return Policy, it is not guaranteed and all sales are final.

If you need additionalphotos or other information, please ask. We want you to be satisfied and be along-term customer, so we are always willing to take additional photos orgather additional information to help you make the most informed purchasedecision possible.

2. HASSLE-FREE RETURNPOLICY.We offer a 30- dayreturn period on all itemsexceptthose that areadvertised as "UAI AS IS" (USED AS IS) or "FPO" (FOR PARTSONLY), or where the listing otherwise indicates that the item is not guaranteedor cannot be returned. If, after your inspection, you find any covered itemunsuitable, at our discretion, we will either provide you with a full refund ofyour purchase price or replace the item with a comparable item at no additionalcosts. All requests for refunds must be made in writing via the messagingsystem and be made within thirty calendar days of the date of payment. Allitems must be returned in the same condition in which they were received. Buyeragrees to pay the return shipping. The refund will typically be made within twoto three business days after we receive the return. All returns are subject tothe Inspection and Acceptance of Product section and other applicableprovisions of these Terms& Conditions. Buyer's failure to pick up an itemwithin the period of our Hassle-Free Return Policy shall not serve to extendthe period for return and refund.

3. MONEY BACKGUARANTEE. In addition to thebenefits offered by our Hassle-Free Return Policy, we also participate in the Money Back Guarantee program which covers you in the unlikely event thatthe item that you receive is different from what is described in our listing.For more information, please see the Money Back Guarantee program details.

4. TRANSACTION &PAYMENT. After clicking"Buy it Now" or successfully negotiating a Best Offer Transaction,please wait to pay until you receive an invoice. The invoice will includeany applicable shipping and handling charges, taxes, fees, etc. Upon receipt ofan invoice Buyer has two business days to make payment in full, unlessother arrangements have been agreed to in writing via the messagingsystem. Transactions that are not paid in full within two days of the issuanceof the invoice will be reported to and the Seller reserves the rightto cancel the transaction and to relist the item. Payment in full is requiredprior to shipping.

5. METHODS OF PAYMENT. We accept payment via PayPal and by extensionvia credit cards accepted through the PayPal program which include Visa, MasterCard, American Express and Discover.

6. RESTOCKING FEES.At Seller's discretion a 20% restockingfee may be charged for any returned item.

7. WARRANTY.Seller is a liquidator of used and surplusequipment and supplies and is not an authorized dealer for the originalmanufacturer. Any reference to or use of a particular brand or trademark is foridentification purposes only and such brands and trademarks are the property oftheir respective owners. Notwithstanding the other terms and provisionscontained herein, all items are sold on an "as is" basis withoutwarranty of any kind including any warranties of merchantability or fitness fora particular purpose.Buyer assumes all risks.

8. INSPECTION ANDACCEPTANCE OF PRODUCT.Buyerrepresents and warrants that he/she is knowledgeable and experienced in thesafe use, operation and maintenance of the item and that he/she is qualified toinspect and evaluate the item to determine its suitability for Buyer's intendedpurpose. Buyer agrees to inspect all items immediately upon receipt. Buyeragrees that if upon Buyer's inspection, an item is not suitable and Buyerintends to return the item then Buyer will immediately notify Seller in writingvia message that such item is not acceptable and that Buyer intends toreturn the item. If Buyer uses the item or fails to provide such notificationto the Seller within thirty calendar days from the purchase date, then Buyer isdeemed to have accepted the item, the sale is final, and Buyer assumes all riskassociated with the use of the item and waives any rights it may have pursuantto the terms of our Hassle-Free Return Policy or otherwise. Buyer assumes allrisks associated with the inspection, operation, use and/or resale of the item.

9. SHIPPING &HANDLING.Buyer isresponsible for freight charges unless the listing details specificallyindicates that the item includes "Free shipping". When the itemlisting specifies the applicable shipping and handling charges, we will packageand ship the item for the specified shipping and handling fee price which willbe automatically included in the Buyer's invoice. For item listings wherethe shipping and handling charges are not specified in the listing, pleasecontact us via message for a quote. (This normally applies to larger itemsrequiring freight).

In the alternative, theBuyer may arrange for its own freight or to pick up the item in person. In mostinstances we will package the item and load it on the Buyer's truck at noadditional fee. However, we reserve the right to assess palletizing, crating orpackaging fees if the Buyer arranges for freight or pick up. Please see thelisting details to see if a palletizing, crating or packaging fee may apply.

All items ship FOB pointof origin which is Woodlawn, Illinois 62898, United States of America unlessanother location is specified in the listing.

We normally ship withinone to two business days of receipt of payment.

10. STORAGE &DELAYED PICK UP.For items that arenot picked up within 30 days of the date Seller receives final payment, wereserve the right to assess a reasonable storage fee for the item and to holdthe item until all the applicable storage fees have been paid. For items thathave not been picked up within 90 days of the date Seller receives finalpayment, Buyer agrees that it relinquishes all rights in the item and thatSeller may retain any and all amounts previously paid by Buyer, including butnot limited to, the purchase price, as liquidated damages and shall furtherhave the right to dispose of or sell the item as it deems appropriate.

11. INTERNATIONALSHIPMENTS.We participate in's Global Shipping Program for qualifying listings. For all otherinternational transactions, Buyer is responsible for all shipping costs, importduties, and/or customs taxes as well as any other fees required by applicableregulatory authorities. Buyer is also responsible for compliance with allapplicable importing laws, rules and regulations for importing to Buyer'scountry from the item's point of origin country and agrees to pay allapplicable charges.

12. CANCELLATION OFSALE.We reserve theright to cancel any sale. If a sale is cancelled for any reason, other thanBuyer's failure to meet its obligations to Seller, we will provide the Buyerwith a full refund.

13.LIMITATIONOF LIABILITY. Notwithstanding any warranty, guarantee or other provisioncontained herein or in any listing or transaction, in no event will Seller beliable for any indirect, special, incidental, exemplary or consequentialdamages of any kind sustained from any cause or based upon any legal theorywhether via contract, tort, negligence, strict tort liability, statutory orotherwise arising out of any sale or offering by Seller. In no event shallSeller be liable to Buyer in an amount exceeding the purchase price of theitem. These limitations of liability include any liability that may arise outof third-party claims and Buyer hereby warrants that it maintains insurance tocover against such claims of third-parties. Any dispute or cause of actionrelating to items purchased hereunder shall have venue, if in state court, inJefferson County, Illinois or, if in federal courts, in the U.S. District Courtfor the Southern District of Illinois.

14. AVAILABILITY &PRIOR SALE.All items areoffered subject to availability and prior sale. In the event you make paymentfor an item that is no longer available we will notify you as soon as possibleand make a full refund of your purchase price.
